Titan Procare ("Company", "we", "us", or "our") is a pharmaceutical distribution company based in Jammu & Kashmir, India. We are the exclusive distributors of AV Care disposable syringes, manufactured by M/s B.K Medical Devices and Syringes.

By accessing this website or placing an order with us, you ("Customer", "Partner", or "you") agree to be bound by these Terms and Conditions in full. If you do not agree, please do not use this website or engage with our services.

2. Use of This Website

2.1 Permitted Use

You may access and use this website for lawful purposes only. You must not use it in any way that causes, or may cause, damage to the website or impairment of its availability or accessibility.

By placing an order or engaging with us as a supply partner, you confirm that you hold all necessary licences, registrations, and authorisations required under applicable Indian law, including the Drugs and Cosmetics Act, 1940, and the Medical Devices Rules, 2017, to procure and use or resell our products.

5. Products

5.1 Titan Procare is a distributor, not a manufacturer. All AV Care branded products are manufactured by M/s B.K Medical Devices and Syringes. Product specifications, quality standards, and regulatory compliance are the responsibility of the manufacturer.

5.2 Product descriptions, specifications, and availability are subject to change without prior notice.

5.3 Available sizes: 2ml, 3ml, 5ml, 10ml, 20ml, 50ml (subject to stock availability).

5.4 All products are supplied sterile in individual ribbon/blister packs. It is the buyer's responsibility to inspect packaging integrity upon receipt and report any damage immediately.

6. Orders and Pricing

6.1 All orders are subject to acceptance by Titan Procare. An enquiry or verbal agreement does not constitute a confirmed order until acknowledged in writing (including via email or WhatsApp).

6.2 Prices are as per our current pricing guide and are subject to revision without prior notice. The price applicable is the one confirmed at the time of order acceptance.

6.3 All prices are exclusive of applicable taxes (GST and any other levies) unless explicitly stated otherwise.

6.4 Minimum order quantities may apply and will be communicated at the time of order.

7. Payment

7.1 Payment terms will be agreed at the time of order and may vary by customer type (hospital, retailer, distributor, etc.).

7.2 Titan Procare reserves the right to withhold delivery or suspend supply in the event of outstanding dues.

7.3 All payments must be made in Indian Rupees (INR) through agreed payment channels.

8. Delivery

8.1 We aim to provide fast and reliable delivery across Jammu & Kashmir. Delivery timelines are estimates and may vary due to logistics, weather, or other factors beyond our control.

8.2 Risk of loss or damage to products passes to the Customer upon delivery.

8.3 Titan Procare is not liable for delays caused by circumstances outside our reasonable control, including natural disasters, government restrictions, or carrier failures.

9. Returns and Complaints

9.1 Given the nature of medical consumables, returns are only accepted in the following circumstances:

• Products delivered in damaged or compromised packaging

• Products that are defective or fail to meet stated specifications

• Incorrect products delivered

9.2 All return requests must be raised within 7 days of delivery, accompanied by photographic evidence.

9.3 Defective product claims will be investigated in coordination with the manufacturer. Titan Procare's liability is limited to replacement of the defective product or a credit note, at our discretion.

9.4 Products that have been opened, used, or improperly stored are not eligible for return.

10. Limitation of Liability

10.1 Titan Procare makes no independent warranties regarding the fitness, efficacy, or safety of the products beyond those provided by the manufacturer.

10.2 To the maximum extent permitted by applicable law, Titan Procare shall not be liable for:

• Any indirect, consequential, or incidental loss

• Loss arising from improper use, storage, or handling of products by the Customer

• Any clinical or patient outcomes resulting from the use of our products

• Any content on third-party websites linked to or from our website

10.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any liability that cannot be excluded under applicable Indian law.

10.4 Our total liability in any circumstance shall not exceed the value of the specific order giving rise to the claim.

11. Confidentiality

Any pricing, business terms, or commercial information shared by Titan Procare with the Customer is confidential and must not be disclosed to third parties without our prior written consent.

12. Governing Law and Dispute Resolution

12.1 These Terms are governed by the laws of India.

12.2 Any disputes arising under or in connection with these Terms shall first be attempted to be resolved amicably through good-faith discussions.

12.3 If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Jammu, Jammu & Kashmir, India.

13. Amendments

Titan Procare reserves the right to update these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Continued use of our website or continued engagement with us after an update constitutes acceptance of the revised Terms.
